1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

"Agreement" means these Terms and Conditions together with any program enrollment confirmation.
"Service" means the financial education programs and related services provided by Fernglen.
"User" / "you" means any individual accessing our website or engaging our services.
"We" / "us" / "Fernglen" means the business operating under the name Fernglen, based at 63/1 Huay Kaew Road, Suthep, Mueang Chiang Mai, Chiang Mai 50200, Thailand.
"Program" means one of the structured educational programs offered by Fernglen.
"Session" means one scheduled educational meeting, whether in-person or online.

2. Acceptance of Terms

By accessing our website or engaging our services, you confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement. Use of our website or enrollment in a Program constitutes acceptance of these terms in full.

3. Description of Services

Fernglen provides financial education services designed to improve participants' understanding of financial concepts relevant to their personal or organizational context. These services are educational in nature and do not constitute financial advice, investment advice, or regulated financial services of any kind.

Our programs are available to residents in Thailand and to others by arrangement. Availability may vary and programs may be modified or discontinued without prior notice.

4. Educational Nature of Services

The information and analysis provided in Fernglen programs is for educational purposes only. Nothing shared during sessions, in written deliverables, or on our website constitutes regulated financial advice, investment recommendations, or professional financial planning services.

Participants are encouraged to consult appropriately qualified financial professionals before making financial decisions. Fernglen accepts no responsibility for decisions made on the basis of educational content delivered in programs.

5. Program Enrollment and Payment

Enrollment in a Fernglen program is confirmed upon receipt of payment. Payment is required prior to the commencement of the first session unless otherwise agreed in writing.

Program prices are as follows (in Thai Baht):

Financial Risk Awareness Program: ฿4,500
Renting vs. Buying Analysis Service: ฿7,000
Financial Education Curriculum Design: ฿32,000

Prices are stated inclusive of applicable taxes unless otherwise specified.

6. Cancellation and Refund Policy

Cancellations made more than 72 hours before the first scheduled session are entitled to a full refund, less any bank transfer fees. Cancellations within 72 hours of the first session are not eligible for a refund, though the session may be rescheduled at our discretion.

If Fernglen cancels a session, we will offer rescheduling or a pro-rated refund for any sessions not delivered. If a program is discontinued before completion due to circumstances within our control, a partial refund will be issued proportionate to the sessions remaining.

7. User Responsibilities

You agree to:

Attend sessions at the agreed times or provide reasonable notice of cancellation or rescheduling
Engage respectfully with Fernglen staff during sessions
Not record sessions without prior written consent
Use materials provided solely for personal reference and not for redistribution or commercial use
Provide accurate information when submitting enquiries or enrolling

8. Intellectual Property

All materials, reports, curriculum documents, risk maps, and other written deliverables produced by Fernglen are and remain the intellectual property of Fernglen unless otherwise agreed in writing. Participants are granted a personal, non-exclusive, non-transferable license to use these materials for personal reference or, in the case of organizational programs, for internal use within the commissioning organization.

Reproduction, redistribution, or commercial use of Fernglen materials without prior written permission is not permitted.

9. Confidentiality

We treat all information shared during sessions with confidentiality, as described in our Privacy Policy. We expect participants to treat any materials or content from sessions as confidential and not to share session content publicly without permission.

10. Disclaimers

Services are provided on an "as available" basis. Fernglen does not warrant that programs will meet any specific outcome expectations or that the content will be applicable to all individual circumstances. No outcomes, results, or benefits are stated or implied.

We are not responsible for the accuracy of third-party data used for illustrative purposes in sessions, including market rates, property prices, or regulatory information, which may change.

11. Limitation of Liability

To the maximum extent permitted by Thai law, Fernglen's liability to you in connection with these services is limited to the total fees paid for the relevant program. We are not liable for any indirect, consequential, or economic loss arising from your use of or reliance on our educational services.

12. Termination

Either party may terminate a program engagement by providing written notice. In such cases, Fernglen will refund fees proportionate to sessions not yet delivered, subject to the cancellation terms in Section 6.

We reserve the right to terminate an engagement immediately and without refund in cases of conduct that is abusive, threatening, or materially in breach of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from this Agreement will first be subject to good-faith negotiation. If unresolved within 30 days, disputes will be referred to the competent courts of Chiang Mai Province.

14. General Provisions

Entire Agreement: These Terms, together with any enrollment confirmation, constitute the complete agreement between the parties.
Severability: If any provision is found to be unenforceable, the remaining provisions continue in full effect.
No Waiver: Failure to enforce any provision does not constitute a waiver of that right.
Assignment: You may not assign your rights under this Agreement without our prior written consent.

15. Changes to These Terms

We may update these Terms from time to time. Updated terms will be posted on this page with a revised effective date. Continued use of our services after changes constitute acceptance of the revised Terms.
